Terms and Conditions

Effective date: June 19, 2026

Please read these Terms and Conditions ("Terms") carefully before using Postessia (the "Service"). By accessing or using Postessia, you agree to be bound by these Terms. If you do not agree, do not use the Service.

1. About Postessia

Postessia is a content-generation and publishing platform that helps individuals and agencies create, schedule, and publish content — primarily for LinkedIn — using AI-assisted tools. Postessia is operated by its founder, Harshit Tiwari, registered as a Sole Proprietorship under MSME in India.

2. Eligibility

You must be at least 18 years old (or the age of majority in your jurisdiction) and capable of forming a binding contract to use Postessia. By using the Service, you confirm you meet this requirement.

3. Account Registration

  • You must provide accurate information when creating an account.
  • You are responsible for maintaining the confidentiality of your login credentials.
  • You are responsible for all activity under your account.
  • Notify us immediately at support@postessia.in of any unauthorized use.

4. Subscription Plans & Payments

  • Postessia offers paid subscription plans (e.g., Solo Pro, Agency, Agency+) as displayed on our pricing page, billed in INR via Razorpay.
  • Subscriptions renew automatically unless cancelled before the renewal date.
  • Prices may change with prior notice; existing subscribers will be notified before any change takes effect on their next billing cycle.
  • If you use an Agency or Agency+ plan to process personal data on behalf of your own clients, you must comply with our Data Processing Agreement requirement in the Privacy Policy. Failure to execute a required DPA before processing such data is a breach of these Terms.

5. Acceptable Use

You agree not to use Postessia to:

  • Generate or publish unlawful, defamatory, hateful, or infringing content
  • Violate LinkedIn's (or any connected platform's) terms of service
  • Attempt to reverse-engineer, scrape, or disrupt the Service
  • Use the Service for spam, mass unsolicited messaging, or fraudulent activity
  • Misrepresent AI-generated content as independently human-written where this would be misleading or unlawful (e.g., in regulated communications)

We reserve the right to suspend or terminate accounts that violate this section, with or without notice, depending on severity.

6. Your Content

  • You retain ownership of the prompts you input and the content generated through your account ("Your Content").
  • You grant Postessia a limited license to process Your Content solely to provide and improve the Service (including via our AI provider).
  • You are solely responsible for reviewing and ensuring Your Content complies with applicable laws and the policies of any platform you publish to (e.g., LinkedIn).
  • AI-generated content may occasionally be inaccurate or require editing — you are responsible for reviewing content before publishing.

7. Intellectual Property

  • The Postessia name, branding, software, and underlying technology are the property of Postessia/its founder and may not be copied, modified, or used without permission.
  • Nothing in these Terms transfers ownership of our platform, code, or branding to you.

8. Indemnification

You agree to indemnify, defend, and hold harmless Postessia, its founder, employees, and affiliates from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable legal fees) arising out of or related to:

  • Your Content — any AI-generated or AI-assisted content you create, edit, publish, or distribute using the Service, including claims of copyright/trademark infringement, defamation, false advertising, or violation of any third party's rights;
  • Your use of the Service in violation of these Terms, applicable law, or the terms of any connected third-party platform (e.g., LinkedIn);
  • Data you submit that you did not have the right to submit, including personal data of your own clients or their end-users processed without a valid legal basis or required DPA (see Privacy Policy).

Postessia reserves the right, at your expense, to assume exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with our defense of such claim.

This section survives termination of your account or these Terms.

9. Third-Party Services

Postessia integrates with third-party services (e.g., LinkedIn, Razorpay, Anthropic's Claude API). Your use of these integrations is also subject to the respective third party's terms. We are not responsible for outages, policy changes, or actions taken by third-party platforms (e.g., LinkedIn API changes or restrictions) that affect Service functionality.

10. Disclaimers

  • The Service is provided "as is" and "as available," without warranties of any kind, express or implied.
  • We do not guarantee specific business outcomes (e.g., follower growth, lead generation, engagement) from using AI-generated content.
  • We are not liable for content rejected, flagged, or penalized by LinkedIn or any third-party platform.

11. Limitation of Liability

To the maximum extent permitted by applicable law, Postessia and its founder shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Service. Our total liability for any claim shall not exceed the amount you paid us in the 3 months preceding the claim. This limitation does not apply to liability arising from gross negligence, willful misconduct, or fraud, or where such limitation is prohibited by applicable law.

(Nothing in this section limits liability where prohibited by law, including certain consumer protections under Indian or EU law that cannot be contractually waived.)

12. Termination

  • You may stop using the Service and cancel your account at any time.
  • We may suspend or terminate your account for violations of these Terms, non-payment, or unlawful activity.
  • Upon termination, your right to use the Service ends immediately; data retention follows our Privacy Policy.

13. Governing Law & Jurisdiction

These Terms are governed by the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in Lucknow, Uttar Pradesh, India, without prejudice to mandatory consumer-protection rights you may have under the laws of your own country of residence (e.g., EU or California residents retain rights under their local consumer law where applicable).

14. Changes to These Terms

We may revise these Terms from time to time. Continued use of the Service after changes take effect constitutes acceptance. Material changes will be communicated via email or in-app notice at least 7 days in advance.

15. Severability

If any provision of these Terms is found unenforceable, the remaining provisions will continue in full force and effect.
